I hereby agree, acknowledge, accept, and confirm the following, on my own behalf:
1. I desire to participate voluntarily in the garden construction, preparation and other activities
sponsored and coordinated by Denver Urban Gardens.
2. I understand, accept, and assume the risks associated with participation in any and all
activities.
3. I assume full responsibility for any injuries which may occur to any of us and do hereby fully
and forever discharge and release the garden/park site landowner and Denver Urban Gardens
(DUG), their employees, executive directors, board members, officers, agents, authorized
volunteer helpers, representatives, consultants, insurers and sureties, and their successors and
assigns (collectively, the “Released Parties”), from any “Claims”.
4. “Claims” as used in this document means any and all claims, demands, damages, rights of
action or causes of action, present or future, whether the same be known, anticipated or
unanticipated, resulting from or arising out of our presence or the presence of our family
members and guests on the garden/park, activities at the garden/park, the use or intended use
of the garden/park, and/or participation in activities connected with DUG including, without
limitation, any of the foregoing resulting from or arising out of the negligence of a Released
Party. Further, I hereby waive any and all Claims any of us may have against a Released Party.
5. I expressly acknowledge that participation in the garden is for my (our) purposes and
convenience and not for the purpose and convenience of any one or more of the Released
Parties.
6. I do hereby grant permission to DUG and its affiliates, representatives and agents to use my
name, image, likeness and voice (“Image”) worldwide and in perpetuity, as memorialized in any
form of media, now known or later developed. I, for myself, irrevocably assign to DUG all right,
title and interest that I may have in the finished pictures, video, audio, or other media, derivative
works, advertising or other copy that contains my Images (“Materials”) and grant to DUG the
right to transfer, broadcast, license and exhibit such Materials without restriction. I, for myself,
hereby waive any right that I may have to inspect or approve the Materials for any use to which
they may be applied, waive any claim to any compensation of any kind through the sale,
license, transfer or any use of the Materials, and release the Released Parties from any liability
associated with the use of such Materials (including by virtue of any blurring, distortion,
alteration, or use in composite form).
7. I have read the above Waiver and Release, agree to its terms and voluntarily consent to
participate in the garden/park.
